Our privacy policy explains what we do with your date, when we collect it and why we collect your personal information. It also explains how we use it and when we may disclose it to others and how we keep it secure.
To all our clients, we request thatyou carefully read this notice as well our general terms and conditions which provide further information on confidentiality, data privacy etc.
This notice does not apply to any other websites that may have a link to ours. Those would be a separate entity or organisation who are responsible for their own privacy policy.
Data collected are processed and stored by Brit Solicitors and we are what is known as the ‘data controller’ of the personal information you provide to us.

Information we require from you :The information we will request from you will depend on what you have requested or instructed us to do for you. The following personal information is generally provided to us:
- Personal data: is the general information that you supply about yourself – such as your name, address, gender, date of birth, contact details, financial information etc.
- Sensitive personal data: May include your racial or ethnic origin, religion, sexual orientation, health data, biometric and other sensitive in nature. Please contact us for more clarification.
In most cases personal data will be only be basic general information and information needed to complete ID checks. However, in some caseswe may require more sensitive information in order for us to deal with matters which you may have instructed us to do.
Where we collect information: This could be from number of sources; including:
- You may provide the information yourself
- You may also provide information relating to someone else – if you have the authorisation to do so
- Information can be passed to us by third parties in order in order so that we can adequately deal with any legal work on your behalf, for example:
- Financial Institution such as banks or building societies
- Organisations that have referred work to us
- GP or other Medical professionals – who provide your personal records / information etc.
Why we need your personal data: The main reason for asking you to provide us with your personal data, is to allow us to provide the service which you have requested us to do – which will be to legally represent you and carry out your legal work on your behalf.
The followingare some examples of the reasons we need to collect your data, although not exhaustive,
- To Verifying your identity
- To verifying source of funds in order to comply with money laundering regulations etc
- In order to communicating with you
- Effectively deal with your legal requirements including:
- Providing you with advice and assistance; carrying out any litigation on your behalf; attend hearings any court hearings on your behalf; preparing compile legal documents or to complete our professional services to you.
- Keep financial records of your transactions and the transactions we make on your behalf
- Allow us to seek advice from third parties; such as legal and non-legal experts which may be required.
- Responding to any complaints made against us
We have a data protection policy in place to manage and secure processing of your personal data. We do not sell or rent your information to third parties. We also do not share your information with third parties for marketing purposes.
In normal circumstances will only use your information within Brit Solicitors Ltd. However, there may be circumstances while we carry out your legal work, where we may need to disclose some information to third parties; for example:
- Government Organisation such as the Home Office
- HM Courts & Tribunal Services
- HM Land Registry to register a property etc
- HM Revenue & Customs; e.g. for Stamp Duty Liability
- Court or Tribunal etc
- Solicitors acting on the other side( usually known either as the respondent or the petitioner)
- Asking an independent Barrister or Counsel for advice, opinions or to represent you in court
- Other Non legal experts or professionals to obtain advice or assistance
- Translation Service providers
- External auditors or our Regulator; e.g. Law Society, SRAetc.
- Bank or Building Society; or other financial institutions
- Providers of identity verification etc
- Any disclosure required by law or regulation; such as the prevention of financial crime and terrorism
- If there is an emergency and we think you or others are at risk
In any event, any of your information which may be shared with third parties, we ensure that they comply, strictly and confidentially, with our instructions and they do not use your personal information for their own purposes unless you have given them your written consent.
Our policy to protect your personal data: We understand that your information is valuable and we take all reasonable measures to protect it whilst it is in our care.
We have up to date technology and security system in place in order to protect personally identifiable data from loss, misuse, alteration or destruction. It is our obligations to make sure that both internal and external parties have agreed to protect your confidentiality of all information and make sure all personal data is handled and processed in line with our strict confidentiality and data protection policies.
We use computer safeguards such as up to date security and data encryption and enforce, where possible, physical access controls to our buildings and files to keep data safe.
How long will we keep your data / files: We keep your personal information, normally in computer or manual files, only for as long we have to fulfil the purposes our services to you or as required by law; or as long as is set out in any relevant contract you may hold with us which would be specified on our client engagement letter i.e
- As long as necessary to carry out your legal work
- For a minimum of 6 years from the closure of your legal work; in case you, or we, need to re-open your case for the purpose of dealing with complaints or claims against us.
- Some information maybe kept longer such as;
- Wills and related documents
- Deeds related to unregistered property
Your rights:Under GDPR, you are entitled to access your personal data ( known as a ‘right to access’). If you wish to make such request, please do so in writing addressed to our Data Protection OfficerAnwar Khan; or contact the person dealing with your matter.
A request for access to your personal data gives you are right obtain to a copy of the data we hold on you – such as your name, address, contact details, date of birth, information regarding your health etc.- but it does not mean you are entitled to the documents that contain this data.
In addition to your right to ‘access your data’, you have the following entitlement:
- The right to be informed: which is fulfilled by way of this privacy notice and our precise and clear explanation as to how we use your personal data
- The right to rectification: you have the right to have personal data rectified if it is inaccurate or incomplete
- The right to erasure / ‘right to be forgotten’: you have the right to request the deletion or removal of your personal data where there is no compelling reason for its continued processing. This right only applies in the following specific circumstances:
- Where the personal data is no longer necessary to be kept by us.
- Where you have given us your authorisation for us to hold your data but you withdrawn such authorisation.
- Where you object for us to process your data and there is no reason for continuing the processing.
- The personal data was unlawfully processed
- Where you object to the processing for direct marketing purposes
- Your right to object: you have the right to object to processing of your data based on legitimate interests; and direct marketing, which applies in the following circumstances;
*Your right to object to stop processing your personal data for direct marketing purposes is absolute – there are no exemptions or grounds to refuse this.
*You must have an objection on grounds relating to your particular situation
*We must stop processing your personal data unless:

- We can show compelling legitimate grounds for the processing which override your interests, rights and freedoms; or
- The processing is for the establishment is to exercise or in defense of a legal claim.
- Your right to restrict us from processing your data: you have the right to request the restriction of your data. When your data processing is restricted, we can only store the data but we cannot use it. This right only applies in the following circumstances:
- When you dispute the accuracy of the personal data – in that case must should restrict the processing until we have verified the accuracy of your data
- When you object to the processing of your data when it was necessary for the performance of a public interest or purpose of legitimate interests, and we are considering whether our organisation’s legitimate grounds override your right
- When processing your data is unlawful and you have requested restriction
- When we no longer require your personal data but you require your data to establish, exercise or defend a legal claim

Marketing data: From time to time we may contact you for the purpose of direct marketing by us. This means that we may use your personal data that we have hold, in accordance with this privacy policy to contact you about our products or services which you may be interested in. The direct marketing communications by us may be provided to you by methods such as social media channels, email or post. We will never call you or send you marketing communications via sms without your specific consent and we will never pass on or sell your details to a third party.

- Submitting an online enquiry i.e. via our social media pages, website
- Following/liking/subscribing to our social media channels or pages
- Take part in one promotions or offers we run on the website or on our social media channels

Sensitive information or specific details will never be used to target marketing communications.
